Terms of Service

Effective date: March 1, 2025

Please read these Terms of Service ("Terms") carefully before using the TextBack AI mobile application (the "App") operated by TextBack AI ("we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use the App (or the minimum age required in your country to consent to data processing). By using the App you represent that you meet this requirement. If you are under 18, you confirm that a parent or guardian has reviewed and agreed to these Terms on your behalf.

2. License to Use the App

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on a device you own or control, solely for your personal, non-commercial purposes in accordance with these Terms.

You may not:

  • Copy, modify, or distribute the App or any portion thereof.
  • Reverse engineer, decompile, or disassemble the App.
  • Use the App for any unlawful purpose or in violation of any regulations.
  • Attempt to gain unauthorized access to our systems or networks.
  • Use the App to harass, threaten, or harm others.

3. Subscriptions & Payments

TextBack AI offers optional auto-renewing subscriptions ("Premium") that unlock additional features. Subscriptions are managed and billed by Apple through the App Store.

  • Billing. Your subscription will be charged to your Apple ID account at the rate displayed at the time of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
  • Free trials. If a free trial is offered, any unused portion is forfeited when you purchase a subscription during the trial period.
  • Cancellation. You may cancel at any time via your Apple ID account settings. Cancellation takes effect at the end of the current billing period; we do not provide partial refunds.
  • Refunds. All purchases are subject to Apple's refund policy. We do not process refunds directly. Contact Apple Support for refund requests.
  • Price changes. We may change subscription prices with reasonable notice. Continued use after a price change constitutes acceptance.

4. AI-Generated Content

TextBack AI uses artificial intelligence to generate suggested replies. You acknowledge that:

  • AI-generated suggestions may be inaccurate, inappropriate, or unsuitable for your situation. Always exercise your own judgment before sending any reply.
  • We are not responsible for any consequences arising from your use or misuse of AI-generated content in real conversations.
  • You are solely responsible for any content you send to third parties, even if it was based on a suggestion from the App.

5. Acceptable Use

You agree not to use the App to:

  • Generate content that is abusive, harassing, defamatory, or threatening.
  • Impersonate any person or entity.
  • Violate any applicable laws or regulations.
  • Circumvent, disable, or interfere with security features of the App.
  • Submit content that infringes on intellectual property rights or contains personal data of third parties without their consent.

We reserve the right to suspend or terminate your access if we determine, in our sole discretion, that you have violated these Terms.

6. Intellectual Property

All content, features, design, trademarks, and code in the App are the exclusive property ofTextBack AI or its licensors and are protected by applicable intellectual property laws. Nothing in these Terms grants you ownership of any App content.

You retain ownership of any text or content you submit to the App. By submitting content, you grant us a limited, royalty-free license to process that content solely for the purpose of providing the App's services to you.

7. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Third-Party Services

The App integrates with third-party services including OpenAI and Apple. Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the acts or omissions of any third-party service provider.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TEXTBACK AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD $10.

11. Indemnification

You agree to indemnify, defend, and hold harmless TextBack AI and its officers, directors, employees, and agents from any claims, liabilities, damages, costs, or expenses (including reasonable attorneys' fees) arising from (a) your use of the App, (b) your violation of these Terms, or (c) your violation of any rights of another person or entity.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California, USA, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved through binding arbitration under the rules of the American Arbitration Association, conducted in English. You waive any right to participate in a class action lawsuit or class-wide arbitration.

13. Changes to These Terms

We may update these Terms at any time. We will notify you of material changes by updating the effective date above and, where appropriate, by an in-app notification. Continued use of the App after changes constitutes your acceptance of the revised Terms.

14. Termination

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. Upon termination, all licenses granted to you under these Terms will immediately cease.
